Lis pendens, Article 12
Article 12 of the Maintenance Regulation deals with the situation of courts in different States being seised with proceedings involving the same cause of action and between the same parties. In such a situation, the Regulation requests any courts other than the court first seised to stay the proceedings of its own motion until the jurisdiction of the court first seised is established
(Article 12(1)) and to decline jurisdiction as soon as the jurisdiction of the court first has been established
(Article 12(2)).
(The same “lis pendens” rule was already used before the applicability of the Maintenance Regulation, see Article 27 Brussels I Regulation.)
