Recognition and Enforcement: The 2007 Hague Convention

 

Besides the Maintenance Regulation, which addresses the recognition and enforcement of decisions among European Union Member States, a number of international or regional multilateral instruments can play a role with regard to the recognition and enforcement of decisions in European Union Member States (click here for other instruments and their relations with each other).

The provisions of the 2007 Hague Convention (once the Convention has entered into force for the European Union Member States) will be relevant for courts in Member States when it comes to the recognition and enforcement of decisions given in non-Member States, which are party to the 2007 Hague Convention, provided, of course, the decision falls within the material scope of application of the Convention between the two States concerned (click here for information on the scope). The Convention will also (once in force for the European Union Member States) be relevant for the recognition and enforcement of maintenance decisions given in European Union Member States in a non-European Union Contracting State to the 2007 Hague Convention.
