Background
Pre-existing international and regional instruments addressing the cross-border recovery of maintenance
Within the European Union, in particular the following two instruments were assisting the cross-border recovery of maintenance before the applicability of the Maintenance Regulation:
- The Brussels I Regulation
- The Regulation on a European Enforcement Order (for the relation of new Maintenance Regulation with these two pre-existing instruments, see also Subchapter 6 of Chapter 2).
Another pre-existing instrument on a regional level is the Lugano Convention of 1988, now replaced by the new Lugano Convention of 2007 , applicable in relation between the European Union Member States and the EFTA States: Iceland, Norway and Switzerland (not Liechtenstein).
