Instruments of the European Union

 

This image gives an overview of the instruments which existed within the European Union and on regional level prior to the Maintenance Regulation.

The Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgements in civil and commercial matters (hereinafter: the “Brussels I Regulation”) entered into force on 1 March 2002 and is today in force for all EU Member States including Denmark since 2007.

Regulation (EC) No 805/2004 of the European Parliament and of the Council of 21 April 2004 creating a European Enforcement Order for uncontested claims (hereinafter: the “European Enforcement Order Regulation”) applicable as of 21 October 2005 and is today in force for all EU Member States except Denmark.

The Convention on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, Lugano, 30 October 2007 (hereinafter: the “new Lugano Convention”) has replaced the Lugano Convention of 1988. It entered into force 1 January 2010 and is today in force for Iceland, Norway, Switzerland and all EU Member States.
