Penalties

 

To enforce European Union and national law, penalties can and sometimes should be applied. They are adopted to ensure that legislation is complied with. In general, penalties have to be effective, proportional and dissuasive. Penalties can also be adopted in relation to the IED. In Article 79, the IED requires member states to determine penalties applicable to breaches of the national provisions adopted pursuant to the IED. Similar provisions were included in the Volatile Organic Compounds Solvents, the Waste Incineration Directive and the Large Combustion Plants Directives.
