The Maintenance Regulation’s relations with other instruments
For the 2007 Hague Convention, Article 48 regulates the co-ordination with the pre-existing Hague Maintenance Conventions of 1958 and 1973 concerning the recognition and enforcement of decisions relating to maintenance obligations. The 2007 Hague Convention will replace these Conventions in relations between the Contracting States but only “in so far as their scope of application as between such States coincides with the scope of application of [the 2007 Hague Convention]”. Similarly, and with the same premise, the 2007 Hague Convention replaces the 1956 UN Convention in relations between the Contracting States, see Article 49 of the 2007 Hague Convention.
As concerns the relationship of the instruments on the law applicable to maintenance obligations, the 2007 Hague Protocol replaces the two prior Hague applicable law instruments of 1956 and 1973 (as between the Contracting States), see Article 18 of the 2007 Hague Protocol.
