Land Damage

 

Land damage is not linked to EU legislation because there is no EU legislation on soil (proposed Soil Framework Directive was withdrawn in 2014). According to the ELD, the land damage threshold is determined as

‘any land contamination that creates a significant risk of human health being adversely affected as a result of the direct or indirect introduction, in, on or under land, of substances, preparations, organisms or micro-organisms’.

As regards the remediation of land damage, the ELD provides for

“remove, control, contain or diminish the significant risk that adversely affects human health taking into account the current or approved future use of the land at the time of the damage”.
